What is the procedure for obtaining a marriage license?

A couple who plans on marrying in New York State may obtain their marriage license from any Town or City Clerk within the State. The prospective couple must be at least 18 years of age. (Under 18 years of age, parental consent is required). The marriage license must be obtained at least 24 hours before the marriage and it is valid for 60 days after issued. The fee for a marriage license is $40.


Proof of age and identity with any of the following:

- Baptismal Record

- Certified Birth Record

- Naturalization Record


You also need a driver's license, passport or employment photo ID.


If either party was previously married, certified divorce papers for every marriage must be presented. If a death occurred, a certified death certificate is required.
